Article copied from www.amigosdemujeres.org David Meza, the young man that was accused of the kidnapping, rape and murder of his cousin, Neyra Cervantes, was freed yesterday afternoon after the chief judge issued an order to free him, based on the ruling that there was no basis to support the charges by the prosecutor. Upon leaving prison, Meza stated, "I will not have found justice until it is know who killed Neyra". After almost 3 years in San Guillermo prision, David Meza finally obtained his freedom. His mother, Maria del Carman Agueta Vargas and the mother of Neyra, Patricia Cervantes, anxiously waited for this moment. The accusation of rape, kidnapping and homicide were not substantiated according to the finding of the judge. Lawyers Adrian Arzate Melendez and Miguel Zapien de la Torre stated that the defense took the case in October, 2004, and a few days later filed a motion to dismiss the case. The first step in achieving the freedom of their client, they said was to remove the charges that were not viable and to support proofs based on scientific evidence. "We implemented proof based on anthropology, sociology and forensics, who ratified the evaluation of the experts who stated that David had been tortured to obtain the confession", added Adrian Arzate. However, both lawyers agreed that the evidence that led to the dismissal was the recreation of the fact that in no way could the vehicle (the prosecution claimed) was used could have reached the place where the body was found and that the only road would be across the C-4. NOTE: The body was found in a very isolated area on top of a mountain in an area not accessible by roads. The only way into the area is through an area controlled by the state police.
